The key is in "If an attempt is made to sign in and list" - did you notice this "list"? Gixen does not list, only submits bids.
That said, of course ebay can kill sniping at any time. Do they have a reason to do so? I don't think so. The sniping services are sometimes just a collateral damage of efforts ebay does to fight fraud.
